Controller responsible for the protection of your personal data

BURST DEL BAJÍO S.A. DE C.V., hereinafter “VidaenYucatan”, with address at Periférico Sur 5472, Col. Olímpica, C.P. 04710, Mexico City, is responsible for processing your personal data and undertakes to ensure the privacy of the personal information obtained through its online services and other means permitted by law.

For what purposes do we collect and use your personal data?

Your personal data will be used to: provide the services and products you request; inform you about changes or new products and services related to what you have contracted or acquired; fulfil obligations undertaken with you; assess service quality; carry out internal studies on our customers’ consumption habits; develop new products and services; register you in contests, programmes or offers you request; and inform you about promotions, offers, news and special events.

For candidates, collaborators and/or employees of BURST DEL BAJÍO S.A. DE C.V. and/or VidaenYucatan, we use personal data to: identify you and carry out recruitment and selection; check whether you meet the profile and entry requirements; prepare and process your application and, where applicable, the employment contract; send information of interest related to VidaenYucatan; build and keep your personnel file; send communications about activities and events, informational, study or work material, service notifications, administrative messages, newsletters, articles, reviews, opinions, invitations to social, academic or work events, discussion forums and similar; and allow access to courses, events and/or work activities you have registered for.

VidaenYucatan may share your personal data with payroll administration services, staff recruitment services, audit and other resource services, and marketing and advertising services.

For these purposes we require: name, address, age, date of birth, nationality, sex, marital status, union membership, email, phone, academic degrees, employment history and records, IMSS affiliation number, R.F.C. tax ID and CURP population ID.

The information provided during registration or enrolment in a programme or promotion is used to carry out internal studies of users’ interests and behaviour, in order to offer them products, services, content and advertising suited to their needs.

What personal data do we obtain, and where?

The information is collected in various ways: when you provide it in person; when you visit www.vidaenyucatan.com and use our online services; or through the complaints and suggestions mailbox.

We collect personal data directly when you provide it yourself by various means, when you take part in our promotions or when you give us information so that we can provide a service. The site www.vidaenyucatan.com does not collect sensitive personal data in any of its forms.

Data we obtain when you visit our site or use our online services may include: name, sex, address, email, phone, R.F.C., card or bank account number, date of birth and age. We may also obtain information from other lawful sources through research surveys and information points: name, sex, email, phone, age, marital status and R.F.C.

How can you limit the use or disclosure of your personal data?

The personal data you provide will form part of a file containing your profile, which the data subject may modify at any time. We advise you to update your data periodically. If you take part in promotions by email, you may deactivate this service at any time. To stop receiving promotional emails, contact our Personal Data Protection Office at privacidad@vidaenyucatan.com.

How to access, rectify, cancel or object to the use of your personal data (ARCO rights)

You have the right to access your personal data that we hold and the details of its processing, to rectify it if it is inaccurate or incomplete, to cancel it when you consider it is no longer needed for the stated purposes or is being used for unconsented purposes or the contractual or service relationship has ended, and to object to its processing for specific purposes. These rights are known as ARCO rights and their exercise is independent of one another.

Procedure. Submit your request in writing to our Personal Data Protection Office, at Periférico Sur 5472, Col. Olímpica, C.P. 04710, Mexico City, or by email to privacidad@vidaenyucatan.com. The request must include: your name and address or a means to receive communications; your ID or documents proving your legal representative’s authority; a clear, precise description of the data concerned and any document justifying rectification; and any other element that helps locate your personal data.

Once the request is submitted, VidaenYucatan has a maximum of 20 business days to respond and a further 15 business days to give effect to the right, where applicable. The deadlines may be extended once for an equal period where justified.

VidaenYucatan may refuse the request in full or in part when: the applicant is not the data subject or the representative is not duly accredited; the data is not held; a third party’s data would be harmed; there is a legal impediment or a decision of a competent authority; the rectification, cancellation or objection has already been carried out; or contractual rights of BURST DEL BAJÍO S.A. DE C.V. and/or VidaenYucatan would be affected.

Providing the data is free of charge; the data subject only covers justified shipping costs or the cost of reproduction. If the same person repeats the request within twelve months, the cost will not exceed three days of the current general minimum wage, unless there are changes to the privacy notice that warrant new queries.

Revoking your consent to the processing of your data

You may revoke at any time the consent you have given for the processing of your personal data. Submit your request in writing to our Personal Data Protection Office, at the address indicated, or by email to privacidad@vidaenyucatan.com, with the same information required for ARCO rights. The response deadlines are the same: 20 business days to respond and a further 15 to make it effective, extendable once for an equal period.

Cookies and web beacons

Cookies are text files automatically downloaded and stored on the user’s device when browsing a website, which let the server remember some data about users who access www.vidaenyucatan.com and track certain behaviours or activities. They let us recognise users, detect the bandwidth selected, identify the most relevant information, calculate audience size and measure some traffic parameters.

Web beacons are images embedded in a web page or email that can be used to monitor a visitor’s behaviour and store information such as their IP address, interaction time and browser type.

We use cookies and web beacons to obtain information such as: your browser type and operating system, the web pages you visit, the links you follow, your IP address and the site you visited before entering ours. These technologies can be disabled from your browser settings (Explorer, Firefox, Chrome).

Transfer of personal data and confidentiality

When the user is on the website (www.vidaenyucatan.com), they share their information with VidaenYucatan, unless otherwise specified. VidaenYucatan is not obliged to keep confidential information the user provides via newsletters and chats, or through cookies, under article 109 of the Federal Copyright Law and article 76 bis, section I, of the Federal Consumer Protection Law.

Information may only be disclosed in special cases, such as to identify, locate or take legal action against people who breach the site’s terms of service, cause harm or interfere with the rights of VidaenYucatan, its property, other users or any person who might be harmed.

VidaenYucatan will not sell, give away, provide or rent confidential information to third parties. If the user does not want their data shared, they may forgo a given service or refrain from taking part in our promotions or contests. VidaenYucatan undertakes not to transfer your personal information to third parties without your consent, except for the exceptions in article 37 of the Federal Law on the Protection of Personal Data Held by Private Parties.

The security and confidentiality of the data users provide when contracting a service or buying a product online are protected by a secure server under the Secure Socket Layer (SSL) protocol; the data sent is transmitted encrypted. Despite increasingly secure tools, the protection of data sent over the Internet cannot be guaranteed 100%; once received, every effort will be made to safeguard the information.

Article 37 of the Federal Law on the Protection of Personal Data Held by Private Parties. National or international data transfers may be carried out without the data subject’s consent when: I. the transfer is provided for in a law or treaty to which Mexico is a party; II. it is necessary for medical prevention or diagnosis, healthcare, medical treatment or the management of health services; III. it is made to holding, subsidiary or affiliate companies under the common control of the controller, or to a parent company or any company of the same group operating under the same internal processes and policies; IV. it is necessary by virtue of a contract concluded or to be concluded in the data subject’s interest, between the controller and a third party; V. it is necessary or legally required to safeguard a public interest or for the administration of justice; VI. it is required for the recognition, exercise or defence of a right in judicial proceedings; and VII. it is required for the maintenance or fulfilment of a legal relationship between the controller and the data subject.

Minors

Safeguarding children’s information is very important, so the data requested to provide services to this group will be kept to a minimum. Parents and guardians are advised to supervise minors when browsing the Internet and to approve any transmission of personal information.

Changes to the privacy notice

VidaenYucatan reserves the right to make changes or updates to this privacy notice at any time, to adapt it to legislative or case-law developments, internal policies or new requirements. Changes will be made available through our website or the last email address you provided. It is the user’s responsibility to read this policy periodically to stay informed of such changes.

Acceptance of terms

This confidentiality and privacy statement is subject to the terms and conditions of the VidaenYucatan website and constitutes a legal agreement between the user and VidaenYucatan. Using VidaenYucatan’s services means the user has read, understood and accepted these terms. If the user does not agree, they should not provide personal information or use the site’s services.

Complaints and reports

If you consider that your right to the protection of personal data has been harmed, or that there has been a breach of the Federal Law on the Protection of Personal Data Held by Private Parties, you may file the corresponding complaint or report with the National Institute for Transparency, Access to Information and Personal Data Protection (INAI): www.inai.org.mx.
